The New California Proposition 65 List

In 2021, the Office of Environmental Health Hazard Assessment (OEHHA) added a total of 8 new substances to the California Proposition 65 list. Interestingly, some of them are likely to be present in consumer and professional products. For example, you will find ‘where used’ details in the table below:

PFAS Substances in the California Proposition 65 List

It should be noted that the following substances are also PFAS:

  • Perfluorononanoic acid (PFNA) and its salts
  • Perfluorooctane sulfonic acid (PFOS) and its salts and transformation and degradation precursors

Undoubtedly, the USA, the European Union, and other countries are increasingly restricting PFAS.

What if a Product Contains a Chemical on the California Proposition 65 List

Because of the Right to Know the principle, products containing Proposition 65 substances are subject to a safe harbor warning. As a result, manufacturers should assess the products against these substances, and maintain the documentation accordingly.

The Safe Drinking Water and Toxic Enforcement Act of 1986 detail the Prop. 65 requirements. Additionally, the updated California Proposition 65 list is available on the OEHHA website.
